New recommended list of appraisers for Russian counter-sanctions regulations

In March 2023 the Russian Ministry of Finance published an excerpt from the minutes of a meeting of the Sub-Commission of the Government Commission for Control over Foreign Investments in the Russian Federation, in which it recommended that the accuracy of a valuation report be confirmed by an expert opinion from an association of appraisers, submitted as part of the counter-sanctions filing together with the valuation report.

On a related note, on 21 April 2023 the Ministry of Finance published a list of seven associations of appraisers which it recommends for the preparation of such expert opinions.

As we advised in one of our previous client alerts, Presidential Decree On Temporary Administration of Certain Assets No. 302, dated 25 April 2023, introduced temporary administration in relation to certain Russian assets owned by foreign groups associated with unfriendly states, namely in relation to Uniper’s Russian subsidiary PAO Unipro and Fortum’s Russian subsidiary PAO Fortum. In July 2023, the list of assets subject to such temporary administration was expanded to include, among others Carlsberg’s Russian subsidiary Baltika Brewery LLC.
